Toreiz sabiedrība notikušo sauca par uzbrukumu visiem žurnālistiem, kuru ir būtiski atklāt. Uzbrukums Jākobsonam joprojām nav atklāts. После появления телевизионного сюжета о Леониде Якобсоне и предстоящем суде я задал Леониду несколько вопросов, на которые он согласился ответить. Я публикую его ответы без изменений в этой записи. Их также можно найти в Facebook здесь.

Леонид, а вместе с ним и свобода слова в Латвии и право любого из нас на доступность информации, на мой взгляд, подвергается преследованиям со стороны властей. Я задал эти вопросы, которые мне кажутся важными, чтобы разобраться в происходящем с связи с публикацией переписки Ушакова с российским шпионом, которую он, Ушаков, на мой взгляд косвенно подтвердил (здесь).

Это важно еще и для того, чтобы поддержать борьбу – я употребляю это слово – Леонида с полицейским хамством и произволом (здесь) по отношению к свободе слова, к людям, конкретно к нему – Леониду Якобсону, которого целый месяц продержали в психушке. Я не знаю, насколько это законно, но если в Латвии есть такие законы, их нужно срочно менять. Такого унижения терпеть нельзя! Примените это в себе, и тогда станет яснее.

Самое главное хамство – купленная политика. Станет ли суд над журналистом судом над хамством купленной политики?

Еще я очень надеюсь, что латвийское общество не останется равнодушно жестокосердным к судьбе журналиста Якобсона – латыши, потому что он не латыш, а русские, потому что он хоть и против жулья, но своего, этнического. Я надеюсь, что весь этот этнический зоопарк закончится.

Вот ответы Леонида:

– Было ли законным то, что следователь Наурис Лиепиньш распорядился поместить Вас на месяц в психиатрическую лечебницу? 

Леонид: Следователь полиции имеет право подозреваемому в любом преступлении назначить судебно-медицинскую экспертизу. Данное решение не подлежит обжалованию.  

– Была ли это попытка оказать на Вас психологическое давление, чтобы заставить отозвать компрометирующие Ушакова публикации?

Леонид: Прежде всего, это было лишь одно из звеньев целой цепочки издевательств. К примеру, Экономическая полиция провела обыск у IT-специалиста, оказывающего техническую помощь KOMPROMAT.LV. У него были забраны из квартиры все носители информации. Формальным поводом для подобных действий стало мое заявление о хакерском нападении на портал KOMPROMAT.LV. Представляете, забрать все носители информации у специалиста, оказывающего мне помощь, по моему же заявлению! Что это, как не издевательство? Вещи ему вернули через полгода без каких-либо извинений. – Намерены ли Вы доказать подлинность опубликованной переписки?

Леонид: Судя по предъявленному мне обвинению, опубликованная корреспонденция принадлежит именно Нилу Ушакову. Со своей стороны могу заверить, что ни одного слова при публикации корреспонденции не менялось. Сегодня уже очевидно: опубликованная переписка – аутентична.

– Насколько я понимаю, Вы не сомневаетесь с ее подлинности и говорите в интервью ТВ-3, что отношения между Ушаковым и российским посольством были финансовые. Известно ли Вам о каких-то действиях властей с целью расследовать содержание переписки?

Леонид: Мне ничего не известно о расследовании прокуратуры по фактам, изложенным в корреспонденции. А корреспонденция Нила Ушакова однозначно свидетельствует о следующем: а) Нил Ушаков отчитывался перед российским разведчиком Александром Хапиловым за потраченные средства; б) Нил Ушаков просил финансирование у российских должностных лиц на выборы в латвийские самоуправления; в) Нил Ушаков в избирательный период будучи кандидатом в депутаты самоуправления управлял новостным блоком Первого Балтийского канала.

– Существует ли связь между Ушаковым и российскими спецслужбами?

Леонид: Однозначно можно утверждать: будучи членом комиссии Сейма по иностранным делам Нил Ушаков не только сотрудничал с российским разведчиком Александром Хапиловым, но и отчитывался перед ним за потраченные средства. В посольстве Российской Федерации в Латвии Александр Хапилов занимал должность советника по культуре, что являлось официальным прикрытием для его разведывательной деятельности.

– Можно ли, по Вашим ощущениям или доступной Вам информации, говорить о том, что должностные лица экономической полиции находятся в заговоре с некими частными бенефициарами против Вас, как распространителя компрометирующей Ушакова информации?

Леонид: Да. Об ангажированности Экономической полиции свидетельствуют многие факты.  

Экономическая полиция сделала всё возможное для ликвидации портала KOMPROMAT.LV. Полицейские не только изъяли сервер, который непосредственно обеспечивал работу портала KOMPROMAT.LV, но и сервер с резервной копией. До сих пор серверы не возвращены владельцу Эдмунду Залите. После многочасового обыска сотрудники Экономической полиции вызвали спецподразделение для конвоирования меня в Экономическую полицию. Это было начало психологической атаки. Я живу в двух минутах ходьбы от Экономической полиции. Никогда не уклонялся от встреч с полицией. Зачем было задерживать меня на двое суток?  

По моей просьбе мой адвокат Андрис Бауманис написал заявление о грозящей мне опасности в следственном изоляторе. Как известно, я публиковал острые статьи про организованную преступность. В частности, портал KOMPROMAT.LV писал о связях одного из лидеров организованной преступности Юрия Полковникова (Полкоша) с известным полицейским (теперь уже бывшим) Олегом Шкутом. При приезде в следственный изолятор полицейские передали заявление моего адвоката сотрудникам изолятора. Те посмотрели заявление и отвергли его по формальному поводу: оно было написано на имя начальника Экономической полиции, а не на имя начальника СИЗО. В результате моими сокамерниками становились разные люди. В том числе, ранее судимый наркоман.  

Еще эпизод. В этот же период времени следователь Экономической полиции Александр Бебрис обратился в полицию с просьбой возбудить уголовное дело против меня по факту клеветы. Речь идет об этой публикации: http://www.kompromat.lv/item.php?docid=readn&id=7143. Факты, изложенные в статье, проверили сотрудники полиции Латгальского предместья Риги. И дело закрыли. Но Александр Бебрис обжаловал решение полиции. Тогда факты, изложенные в статье, проверили еще раз. И снова дело закрыли.  

Во время следствия свидетельские показания против Александра Бебриса дали предприниматели, испытавшие на себе произвол со стороны Экономической полиции. Вот цитата, которая не понравилась инспектору Экономической полиции Александру Бебрису: 

“В поле зрения KOMPROMAT.LV инспектор Экономической полиции Александр Бебрис (ALEKSANDRS BEBRIS) попал летом этого года, когда инициировал преследование предпринимательницы Светланы Урядовой. У женщины был проведен обыск, изъят компьютер, ее саму признали подозреваемой. Спустя несколько месяцев, когда фальсификация материалов уголовного дела стала очевидна, инспектора Бебриса отстранили от расследования. Понятно, что преследование Светланы Урядовой, подвергшейся унизительной процедуре обыска, прекратилось. Но никакого наказания Александр Бебрис не понес. У него даже не нашлось времени извиниться перед Светланой Урядовой, которая незаслуженно пострадала не только морально, но и материально, в частности, затраты на гонорар адвоката ей никто не компенсировал. По неофициальным сведениям, инспектора мотивировали бизнес-оппоненты Светланы Урядовой”. 

Полиция Латгальского предместья установила: ни какой клеветы здесь нет.  

За время следствия Экономическая полиция ни разу не вызвала меня на допрос. 

К слову, Нил Ушаков написал на меня заявление не только в Экономическую полицию, но и в Государственную инспекцию данных (Datu Valsts Inspekcija). Расследование велось около года. В результате меня признали правомочным публиковать корреспонденцию. – Насколько, по-Вашему, велика вероятность того, что суд признает публикацию переписки Ушакова действиями в интересах общества, а действия, совершенные против Вас лично, преступлением?

Леонид: Не берусь судить. Но еще раз подчеркну: ни одного письма о личной жизни Нила Ушакова не публиковалось. Портал Puaro.lv, связанный с Нилом Ушаковым, создал целую галерею из ворованных фотографий интимного характера Элины Эгле. Но это не заинтересовало ни Государственную инспекцию данных, ни Экономическую полицию. Эти личные снимки до сих пор доступны. 

Где же закон? Следует отметить, что Латвийская Ассоциация журналистов (Latvijas Žurnālistu asociācija) осудила публикацию фотографий, полученных незаконным способом. “Публикация этих фотографий не может быть оправдана, так как раскрытие информации не дает никакой общественной пользы, не имеет ничего общего с общественной или политической деятельностью Элины Эгле, и касается только личной жизни”, – говорится в заявлении.  

В случае же с корреспонденцией Ушакова можно однозначно утверждать, что её публикация несет общественную пользу и напрямую связана с общественной или политической деятельностью.

– Если суд признает Вашу правоту, каковы будут последствия?

Леонид: В очередной раз пострадают латвийские налогоплательщики, за чей счет покрываются судебные издержки.
